If your refugee claim has been rejected by the Immigration and Refugee Board (IRB), you may have the option to appeal the decision to the Refugee Appeal Division (RAD). The RAD reviews certain types of decisions made by the IRB and provides an opportunity for reconsideration.
To appeal to the RAD, you must submit your Notice of Appeal within 15 days of having received it. Your lawyer will submit written arguments to the RAD to demonstrate the errors or omissions in the original decision. The RAD will then review of your case, and either accept or reject the appeal.
